Luau’s Nintendo Switch 2 Giveaway – Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.

A purchase or payment will not increase your chances of winning. Contest is open only to legal residents of the United States who are 18 years of age or older. Void where prohibited by law. By entering this contest, you agree to these Official Rules and the decisions of Luau Digital, Ltd., which are final and binding.

Eligibility

Location and Age: The contest is open to U.S. residents who are 18 years of age or older. Proof of residency and age may be required.
One Entry Per Account: Participants must use their own Luau account with true, accurate information. Creating fake accounts or false identities to enter is prohibited.
Sponsor’s Employees: Employees, officers, and directors of Luau (the “Sponsor”), its affiliates, partners, advertising/promotional agencies, and the immediate family or household members of each are not eligible to enter or win.

Contest Period

Start and End Dates: This promotion begins on August 1, 2025 and ends on November 27, 2025 (the “Contest Period”).
Time Frame: Entries will be accepted starting at 12:00 AM (midnight) on August 1, 2025, and the opportunity to enter will close at 11:59 PM on November 27, 2025 (all times Central Time). Sponsor’s server timestamp or records are the official time-keeping method for this contest.

How to Enter

To enter the giveaway, eligible participants must complete all of the following steps during the Contest Period:

Create an Account: Sign up for a free account on Luau’s web app (https://app.luau.co) if you do not already have one. The Luau platform is currently in beta, but all core features needed to participate are fully available and free to use.
Create and Host a Real Event: Using the Luau app, create an in-person event between August 1, 2025 and November 27, 2025. Virtual events do not qualify for this contest. Your event must be a real gathering that actually occurs during the Contest Period.
Minimum RSVP Requirement: To be eligible, your event must receive at least one confirmed “Yes” RSVP from another real person. Events without at least one external RSVP will not count as a valid entry.
Qualifying Entry: Each eligible event you host during the Contest Period will count as one (1) entry into the contest drawing. You may earn multiple entries by hosting multiple eligible events, provided each is a distinct, real gathering. RSVPs beyond the first do not increase your odds of winning.
No Purchase Required: Creating a Luau account and event is completely free. You do not need to pay for any service or purchase any product to enter. (Any optional expenses you choose to incur for hosting your event, such as food or decorations, are up to you and are not required or provided by the Sponsor.)
Anti-Gaming Enforcement: Events must be authentic. Creating large numbers of low-effort or repetitive events—such as hosting back-to-back events with the same guest repeatedly RSVP’d—may result in disqualification. Sponsor reserves the right to disqualify any participant whose behavior appears to be intended to game the contest.

Entries that do not meet all the above criteria (for example, events without a valid RSVP or events that clearly violate the spirit of the giveaway) will be disqualified. The Sponsor is not responsible for late, incomplete, or misdirected entries, including any technical issues or outages on the Luau platform that could affect your ability to create an event or gather RSVPs.

Event Requirements (Hosting the Event)

This giveaway is about bringing people together, so simply creating an event online is not enough – you must follow through and host the gathering:

Timing: Your eligible event must take place during the official Contest Period, which runs from August 1, 2025 to November 27, 2025.
Event Photo Proof: The winner will be required to provide proof that at least one of their eligible events took place by submitting a group photo from the event. The photo must clearly show you (the event host) along with at least one of your attendees together at the gathering.
Submission of Photo: The event photo will need to be submitted to Luau via email or MMS (text message). Detailed instructions on how and where to send the photo will be provided directly to the winner after the drawing. The winner should be prepared to email or text the photo by the deadline given in the winner notification.
Authenticity: The event and photo must be genuine. Do not attempt to stage or fabricate an event solely for the contest without actual attendees, as this would violate the spirit of the giveaway. Luau reserves the right to reject any photo that appears to be manipulated or not from a real gathering.

Winner Selection and Notification

Random Drawing: One (1) potential winner will be selected in a random drawing from all eligible entries. The drawing will take place on November 29, 2025 (or the next business day if necessary). Each entry will have an equal chance of winning. Odds of winning depend on the total number of eligible entries received.
Selection Process: The random drawing will be conducted by the Sponsor using either an automated randomization tool or another impartial method.
Notification of Winner: The winner will be contacted promptly using the contact information associated with their Luau account. This may include phone, email, text, or in-app message. If the winner cannot be reached within 72 hours, or is found to be ineligible, an alternate winner may be selected.

Prize

Grand Prize: One (1) Nintendo Switch 2 console.
Approximate Value: $449.99 USD.
Delivery: The prize will be delivered to the winner or made available for local pickup in the Birmingham, AL area.
No Substitution or Transfer: The prize is non-transferable and cannot be exchanged for cash. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
Warranty: The prize is awarded “as is.” Any manufacturer warranty will apply, but the Sponsor offers no additional warranties and accepts no liability for use or misuse of the prize.
Taxes: Any federal, state, or local taxes are the sole responsibility of the winner.

Verification and Prize Forfeiture

Winning this contest is contingent upon full compliance with these Official Rules:

Verification of Eligibility: The potential winner will be required to prove that they meet the eligibility requirements and have adhered to all contest rules. This verification may include providing a valid government-issued ID and the event photo described above.
Event Legitimacy: Sponsor may request additional information to confirm that each event submitted was a genuine in-person gathering. Use of fake attendees, duplicate accounts, or repetitive events with no meaningful variation may lead to disqualification.
Disqualification for Abuse: Entrants who attempt to manipulate the contest—by creating fake events, repeatedly using the same guest, or engaging in other deceptive tactics—will be disqualified. Luau reserves the right to enforce this rule strictly.
Final Decision: All contest entries and potential winners are subject to verification by Luau. Luau’s decisions are final in all matters relating to verification and rule compliance.

Publicity Rights

Use of Identity: By entering, you agree that if you are the winner, Luau may use your name, city, and submitted event photo in connection with contest publicity, including on social media, website, or marketing materials.
No Additional Compensation: No additional compensation will be given beyond the prize.
Privacy Considerations: Luau will make reasonable efforts to respect the privacy of other individuals in your event photo. We may blur faces upon request or as appropriate.

General Conditions

Compliance with Laws: Contest is subject to all applicable laws. Void where prohibited.
Right to Modify: Sponsor reserves the right to cancel, modify, or suspend the contest in the event of technical issues or other circumstances beyond its control.
Platform in Beta: Luau’s platform is in beta. Sponsor is not responsible for any platform-related technical issues that may affect entry.
Tampering or Misuse: Any attempt to tamper with the contest or violate these rules will result in disqualification.
Liability Waiver: By entering, you release Luau and its affiliates from any liability related to participation, event hosting, or use of the prize.
Indemnification: You agree to indemnify the Sponsor for any claims resulting from your entry, conduct, or violation of the rules.
No Affiliation with Nintendo: This contest is not sponsored, endorsed, or administered by Nintendo.
Governing Law: This contest and its rules are governed by the laws of the State of Alabama.
